Terms and Conditions

2.1 Account Requirements

To use our service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept full responsibility for all activity under your account
• Notify us immediately of any unauthorized access

2.2 API Keys

• API keys are confidential and must not be shared
• You are responsible for all usage under your API keys
• Lost or compromised keys should be revoked immediately
• We reserve the right to revoke API keys at any time

4.1 Rate Limits

API requests are subject to rate limits based on your plan:

• Free: 60 requests/minute
• Starter: 200 requests/minute
• Growth: 500 requests/minute
• Scale: 2,000 requests/minute
• Unlimited: Custom rate limits

4.2 Monthly Quotas

Monthly validation quotas reset on the first day of each calendar month:

• Free: 1,000 validations/month
• Starter: 10,000 validations/month
• Growth: 100,000 validations/month
• Scale: 500,000 validations/month
• Unlimited: Unlimited validations

4.3 Fair Use

Even on unlimited plans, we reserve the right to throttle or suspend accounts that exhibit abusive usage patterns that negatively impact service availability for other customers.

5.1 Subscription Plans

• All prices are in EUR unless otherwise stated
• Subscriptions are billed monthly or annually in advance
• Annual plans receive a 20% discount
• Payment is processed securely through Stripe

5.2 Price Changes

We reserve the right to modify our pricing at any time. Price changes will:

• Be communicated at least 30 days in advance
• Not affect active subscriptions until renewal
• Allow you to cancel before renewal to avoid the new price

5.3 Refund Policy

• First-time purchases: 3-day money-back guarantee
• Refunds are pro-rated based on unused time
• Usage-based refunds: Refunds minus cost of validations used
• No refunds for violations of terms or service abuse
• Refund requests: [email protected]

5.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your subscription remains active until the end of the billing period
• You will not be charged for subsequent billing periods
• Your account will be downgraded to the free plan
• API access continues with free plan limits

5.5 Failed Payments

If a payment fails:

• We will attempt to charge your payment method up to 3 times
• You will receive email notifications
• After 7 days, your account will be downgraded to the free plan
• After 30 days, your account may be suspended

6.1 Uptime Commitment

We strive for 99.9% uptime, excluding:

• Scheduled maintenance (announced 48 hours in advance)
• Emergency maintenance
• Third-party service outages
• Force majeure events
• DDoS attacks or security incidents

6.2 Service Modifications

We reserve the right to:

• Modify or discontinue features with 30 days notice
• Perform maintenance that may temporarily affect availability
• Update API endpoints (with versioning support)
• Change service specifications to improve performance

7.1 Your Data

• You retain all rights to data you submit to our service
• We process your data solely to provide the service
• We act as a data processor under GDPR
• We do not sell or share your data with third parties

7.2 Data Processing Agreement

By using our service, you agree to our data processing practices as described in ourPrivacy Policy. For enterprise customers, we can provide a separate Data Processing Agreement (DPA) upon request.

7.3 Your Responsibilities

You are responsible for:

• Ensuring you have the right to validate submitted email addresses
• Complying with applicable data protection laws (GDPR, CCPA, etc.)
• Obtaining necessary consents from email address owners
• Not submitting sensitive personal data (health, financial, etc.)

8.1 Our Rights

The service, including its code, design, documentation, trademarks, and all related intellectual property, is owned by Nuno Miguel Duarte Unip. Lda. You may not:

• Copy, modify, or create derivative works
• Reverse engineer or decompile the service
• Remove or alter any proprietary notices
• Use our trademarks without written permission

8.2 License Grant

We grant you a limited, non-exclusive, non-transferable license to use our API for the duration of your subscription, subject to these Terms.

While we strive for accuracy, email validation is inherently imperfect. We do not guarantee:

• 100% accuracy of validation results
• That valid emails will accept messages
• That invalid emails will bounce
• Real-time status of mailboxes

9.3 Limitation of Liability

9.4 Indemnification

You agree to indemnify and hold harmless Nuno Miguel Duarte Unip. Lda from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your data or content submitted to the service

10.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

10.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• Your account is used for illegal activities
• Your payment fails and is not resolved within 30 days
• We are required to do so by law
• Your usage threatens service availability for others

10.3 Effect of Termination

Upon termination:

• Your API keys will be immediately revoked
• You will lose access to paid features
• Your data will be retained for 90 days for recovery
• After 90 days, your data will be permanently deleted
• No refunds will be provided for violations of Terms

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any disputes arising out of or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Portugal.

11.3 Informal Resolution

Before filing a claim, we encourage you to contact us at [email protected] to seek an informal resolution.

12.1 Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the service after changes constitutes acceptance.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.3 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Nuno Miguel Duarte Unip. Lda.

12.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms at any time without notice.

12.5 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
